Introduction
These Terms and Conditions apply to all use of the Cupworks Limited website and to all orders placed with Cupworks Limited. By accessing the website or purchasing products, you agree to be bound by these Terms. Cupworks Limited supplies custom-printed reusable cups manufactured in Germany and delivered to customers throughout the United Kingdom. These Terms explain how orders are processed, how payment works, and what responsibilities apply to both the customer and Cupworks Limited.
Use of the Website
The website is provided for general information and ordering purposes. Cupworks Limited makes every effort to ensure that information shown on the website is accurate and up to date; however, no guarantee is made regarding completeness, accuracy or suitability. By using the website, you agree not to misuse it, attempt unauthorised access, introduce harmful software, or disrupt its normal operation. Any links to external websites are provided solely for convenience and Cupworks Limited is not responsible for their content or security.
Ordering and Artwork Approval
Orders are accepted based solely on the details supplied by the customer. Customers must ensure that artwork, logos and text submitted for printing are accurate, lawful and owned or licensed for use. Production will begin only once full payment and final artwork approval have been received. Artwork approval confirms that the customer accepts the design, colours, layout and spelling. Small variations in colour, print alignment or finish may occur as part of normal commercial printing processes and are considered acceptable within industry tolerance.
Prices, Payment and VAT
All prices are quoted exclusive of VAT unless otherwise stated. Cupworks Limited is registered for VAT in the United Kingdom, and VAT will be added to all UK orders at the prevailing rate. Payment must be made in full before production begins unless a written agreement provides otherwise. Prices may change at any time without notice, but changes will not affect orders that have already been confirmed by Cupworks Limited.
Import Duties and Customs Charges
Cupworks cups are manufactured in Germany and shipped to the United Kingdom. As a result, orders may be subject to UK import VAT, customs duty, and courier handling fees when entering the country. These charges are applied by UK customs and couriers, not by Cupworks Limited.
Even though Cupworks Limited is VAT registered and charges UK VAT on invoices, import VAT may still be applied at the border depending on shipment value and the customs declaration process used by the courier. Customs duty may also apply depending on the commodity classification and value of goods.
The customer is responsible for paying any import-related charges. If the customer is VAT registered, reclaiming import VAT may be possible through HMRC subject to their rules. By placing an order with Cupworks Limited, the customer accepts responsibility for any customs charges, duties or handling fees that may arise.
Production and Delivery
Production times begin once full payment and artwork approval have been received. Delivery dates are estimates and not guaranteed. Delays may occur due to manufacturing lead times, courier issues, customs processing, or events outside Cupworks Limited’s control. Risk in the goods passes to the customer once the shipment is collected by the courier in Germany, and ownership transfers to the customer once payment is received in full. Cupworks Limited is not liable for delays beyond its control.
Cancellations
Orders may be cancelled only before production has begun. Once artwork is approved and production has started, the order becomes non-refundable, as the products are custom-made. If the customer cancels before production, Cupworks Limited reserves the right to charge for any design, administration or preparation work already completed.
Returns and Faults
Because custom-printed products are made specifically to order, they cannot be returned unless defective. Customers must inspect goods upon arrival and report any defects within seven days of delivery. Claims must include clear photographs and a detailed description. Cupworks Limited may request return of samples for inspection. If a manufacturing fault is confirmed, Cupworks Limited may offer a reprint or partial refund at its discretion. Minor variations in colour, print density, positioning or finish are considered normal and do not qualify as defects.
Liability
Cupworks Limited is not responsible for loss of profit, loss of business, loss of opportunity, damage to reputation or any indirect or consequential loss arising from the use of its products or its website. Liability is limited strictly to the value of the order placed. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or any liability that cannot legally be excluded.
Intellectual Property
All designs, photographs, templates and written content on the Cupworks website remain the property of Cupworks Limited or the respective rights holder. Customers confirm they have all necessary rights to use any artwork, logos or text provided for printing. Cupworks Limited accepts no liability for copyright, trademark or licensing disputes arising from customer-supplied artwork.
Privacy and Data Protection
Cupworks Limited collects and processes personal information in accordance with UK data protection law. Information is used for order fulfilment, customer service and website functionality.
